只是帮人挪一下摩托车,突然窜出几个大汉,称是车主,对自己一阵拳打脚踢。完事后,还以**相要挟,索要5万元现金。原来,这一切都是卢某设的一个局。昨日,海都记者获悉,卢某一审被判犯敲诈勒索罪,判处有期徒刑1年,并处罚金4万元。
2011年12月初,卢某伙同贾某、易某(均已判刑)共谋,通过栽赃他人盗窃摩托车,敲诈勒索*财。同年12月11日下午,贾某以雇用为由,骗取被害人丁某的信任,后由卢某驾驶摩托车载丁某、郑某到平和县霞寨镇石门径水库岸边。该处预先停放几辆摩托车,卢某找借口让丁某、郑某给一辆黑色女式踏板摩托车换个停放位置,易某和小吴(已判刑)即以车主的身份出现,指责丁某、郑某盗窃摩托车并殴打他们。
易某、小吴以**和限制人身自由相要挟,向丁某、郑某索要5万元。贾某假意从中调解,郑某同意支付2万元。后因郑某家属**、丁某逃跑而未得逞。
去年10月17日,卢某到公安机关投案。经平和检察院提起公诉,**审理认为,卢某行为已构成敲诈勒索罪。
